1. Acceptance of Terms

By accessing and using the BNS Prepaid Meters system, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

BNS Prepaid Meters provides a water management system that allows landlords to manage prepaid water meters for their properties. The service includes:

• Meter registration and management
• Payment processing through M-Pesa
• Token generation for water access
• SMS notifications for tenants
• Revenue sharing and payout management

3. Landlord Responsibilities

As a landlord using our service, you agree to:

• Provide accurate information during registration
• Maintain valid bank account details for payouts
• Ensure proper installation and maintenance of water meters
• Comply with local water regulations and standards
• Provide support to tenants regarding water access
• Keep your account information up to date

4. Payment Terms

Payment processing is handled through M-Pesa integration. Revenue sharing is as follows:

• 90% of tenant payments go to the landlord
• 10% is retained by BNS as service fee
• Payouts are processed within 24-48 hours
• All amounts are in Kenya Shillings (KES)

5. Data Privacy and Security

We are committed to protecting your privacy and personal information. We collect and use information in accordance with our Privacy Policy, including:

• Personal information for account management
• Payment information for processing transactions
• Usage data to improve our services
• Communication records for customer support

6. Service Availability

While we strive to maintain high service availability, we cannot guarantee uninterrupted access. Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues
• Third-party service disruptions (M-Pesa, SMS providers)
• Force majeure events

7. Limitation of Liability

BNS Prepaid Meters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

8. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will be suspended
• Outstanding payments will be processed
• Account data will be retained for legal compliance
• You remain responsible for any outstanding obligations

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
